And notice has to be more than just an message sent to an
auto-subscribe address.

How about this compromise:

Archivers may autosubscribe to any public mailing lists, but they must
read any intro message(s) they get back.  In this message, in
human-readable text (not machine code) it will say whether archivers
are permitted and under what conditions.  If they are disallowed, they
must unsubscribe.  Anyone running an auto-archiver must dedicate human
resources to read all intro messages for such statements.

All other subscribers are expected to read these messages (not just
parse them with programs).  If archivers wish to be treated with the
courtesy given to any other responsible subscriber of my lists, they
must act like one by reading (in person, not with a program) all of my
intro texts in their entirety.

Seems more than fair.  Under such conditions I will welcome
auto-subcribes by archivers (who will then have to unsubscribe to my
list, but that is my choice).

Archivers do not deserve greater consideration than other subscribers
nor do they have less responsibility to read and follow my mailed
terms and conditions of use of my list.

Oh, and just like any other subscriber, they must monitor the list for
changes in terms and conditions of use.
