I like this idea. It seems logical to me... if you open your list to
public subscription, then that means the content is fair game unless
otherwise stated.

The problem is, you can't stop them from archiving your list, so they win.
I'll take a realistic solution that works over an idealistic solution that
doesn't. People are lazy... if we ask them to throw a flag in their
automated tools, there is a chance of it being implemented (ie robots.txt).
As soon as you require human intervention, it's too much work and they're
just going to ignore you.
