    This does bring up an interesting side issue: does *anyone* out there
    providing hosted e-mail declare a level of confidentialily and not
    claim ownership of content ? The two are separate questions... the
    latter being a snide dig at the recent Passport T&Cs.

We do (eList eXpress <http://www.elistx.com>).

We actually provide only relay related services (except for storing
archives of mailing lists) but our service agreement states the data is
yours.  Even if you choose to change service providers, as long as your
account is in good standing we will make sure you get your data.

We also state that we reserve the right to do whatever is necessary to
ensure the continued operation of the service.  Thus, your data is
private, i.e., we don't look at it and we don't share it, unless there's
a problem and then all bets are off.  We certainly don't go out of our
way to look at things that aren't ours, but I don't see any other way to
do this.
