Have you talked to the gmane folks?  This is a pet project of Lars
Ingebrigtsen, the author of Gnus and one of the coolest people that I know
on-line anywhere.  I'm quite sure he's not trying to make life hard for
anyone and would be happy to change policies to fix whatever problems you
encounter.  I'm guessing it was just an oversight, or like Chuq said, that
they weren't able to find where it was published that your lists shouldn't
be externally archived.
