breach of subscribe??

I sent a mail message to an md 1.94.3 mailing list from an 
unsubscribed persons account and it landed into all other 
subscribers' mailboxes ok. The list has open for all 
config variables. I still thought u had to subscribe even 
though all opens are set to have a message circulated.
Is there a config variable that should be set to list
 that only allows distribution file addresses to be used.
I thot this would have been automatic.
